These Terms of Service ("Terms") govern your access to and use of Ice9.ai ("Service"), operated by Ice 9 Designs ("we," "us," or "our"), a California-based company. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
PART 1: GENERAL PROVISIONS
(Applies to all users)
1. Acceptance and Eligibility
1.1 Age Requirement. You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years or older.
1.2 Business Use. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
1.3 Image Content Requirement. All images uploaded to the Service must comply with the Acceptable Use Policy incorporated herein. You represent and warrant that you have the legal right to upload and process all images submitted to the Service.
2. Account Registration and Security
2.1 Account Creation. To use the Service beyond the free demo, you must create an account. You agree to provide accurate, current, and complete information during the registration process.
2.2 API Keys. For API access, you will be issued one or more API keys. You are responsible for maintaining the confidentiality of your API keys and for all activities that occur using your API keys.
2.3 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at security@ice9.ai of any unauthorized use of your account or API keys.
2.4 Account Termination. We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion.
3. Description of Service
3.1 Service Function. Ice9.ai is an image analysis service that uses artificial intelligence and computer vision to analyze uploaded images and return structured data describing the content of those images. The Service uses a multi-model consensus system to improve accuracy and reduce hallucinations.
3.2 Service Offerings. The Service is available in two forms:
(a) Free Demo: A limited demonstration version available through our web interface for evaluation purposes. The Free Demo is subject to rate limits and may have reduced functionality compared to the paid API.
(b) Paid API: A commercial API service that provides programmatic access to image analysis capabilities. API access requires an account and is subject to usage-based pricing.
3.3 Content Moderation Features. The Service includes optional content moderation capabilities using NudeNet technology to attempt to detect nudity or sexually explicit content in images. When detected, the Service returns coordinate data indicating regions where such content may be present. Important limitations:
- The Service does NOT store, serve, return, or transmit images in any form
- The Service returns only coordinate data (bounding box locations) for detected content
- Content moderation detection is not 100% accurate and may produce false positives or false negatives
- You are solely responsible for how you use the coordinate data returned by the Service
- The presence of content moderation features does not constitute a warranty that all inappropriate content will be detected
3.4 Image Storage Policy. WE DO NOT STORE UPLOADED IMAGES. Images submitted to the Service are processed in memory and are immediately discarded after analysis is complete. We retain only the analysis results (structured data) generated from your images, not the images themselves.
3.5 Data Retention. Analysis results (structured data output) are stored and associated with your account so you can retrieve them later at no additional charge. Retrieval of previously generated analysis results and polling for job status do not consume API credits.
3.6 Service Availability. We do not guarantee uninterrupted or error-free operation of the Service. The Service is provided on a commercially reasonable efforts basis.
3.7 Service Modifications. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. For paid API customers, we will provide reasonable advance notice of material changes that would significantly impact functionality.
3.8 Content Flagging Features. The Service includes optional content flagging capabilities that detect the presence of specific objects, symbols, or content categories in images based on user-configurable rules. Content flagging:
(a) Reports factual presence of detected elements, not legal determinations;
(b) Does not constitute a determination that content violates any law, regulation, or policy;
(c) May produce false positives (flagging benign content) or false negatives (failing to detect restricted content);
(d) Is provided as a detection tool only - users are solely responsible for interpreting results and taking appropriate action;
(e) Does not replace human review or judgment;
(f) Should not be used as the sole basis for legal, enforcement, or compliance decisions.
You acknowledge that Ice9.ai provides infrastructure for content detection, not moderation policy enforcement or legal compliance services.
3.9 Non-Exclusivity of Results. Nothing in these Terms prohibits Ice9.ai from providing analysis results or content flags to other customers that are the same as or similar to results provided to you, including results derived from content that is the same as or similar to content you submit. Analysis methodologies, detection patterns, and flag configurations are not exclusive to any customer.
3.10 Export Controls and Sanctions. The Service, including software, AI models, and analysis results, may be subject to U.S. export control laws and regulations. You agree not to export, re-export, transfer, or make available the Service or any analysis results in violation of such laws. You represent that you are not (a) located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country, or (b) listed on any U.S. Government prohibited or restricted parties list.
4. Pricing and Payments
4.1 Free Demo. The Free Demo is provided at no charge and is subject to rate limiting and usage restrictions. We reserve the right to modify or discontinue the Free Demo at any time.
4.2 API Pricing. The paid API operates on a per-image pricing model. Current pricing is displayed on our website at https://ice9.ai/pricing and is subject to change with thirty (30) days' notice to existing customers.
API USERS - Per-Image Pricing: You are charged for each image analysis request that successfully processes. Example pricing structure: - First 1,000 images/month: $0.05 per image - Next 9,000 images/month: $0.03 per image - Next 90,000 images/month: $0.02 per image - Over 100,000 images/month: Contact for enterprise pricing
4.3 Billing. API usage is billed based on the number of images processed. You will be charged only for image analysis requests; retrieval of previously generated results and status polling are provided at no additional charge.
API USERS - No Charge For: - Retrieving previously generated analysis results (GET requests) - Polling job status - Failed requests (HTTP 5xx errors caused by Service issues) - Requests rejected due to invalid input (HTTP 4xx errors) beyond the first validation attempt
API USERS - Charged Operations: - Each successful image analysis request (HTTP 200 responses with analysis data) - Requests that fail due to prohibited content (after processing) - Duplicate analysis of the same image (we do not deduplicate identical images)
API USERS - Billing Cycle: API usage is billed monthly in arrears. Invoices are generated on the first day of each month for the previous month's usage.
4.4 Payment Terms. Payment is due according to the billing schedule associated with your account plan. All payments are processed through third-party payment processors and are subject to their terms of service.
API USERS: Payment is due within 15 days of invoice date. Overdue payments may result in: - API access suspension after 15 days - Account termination after 30 days - Late fees of 1.5% per month on overdue balances
4.5 Taxes. You are responsible for all taxes, duties, and assessments (except taxes based on our net income) associated with your use of the Service.
4.6 Refunds. API charges are generally non-refundable except in cases of Service failure attributable to us or as required by law. If you believe you have been incorrectly charged, you must notify us within thirty (30) days of the charge.
API USERS - Billing Disputes: If you dispute a charge, you must notify us within 30 days of the invoice date. We will investigate and respond within 15 business days.
4.7 Overdue Payments. If payment is overdue, we reserve the right to suspend your API access until payment is received.
4.8 Usage Monitoring. API USERS: You can monitor your API usage and costs in real-time through your account dashboard at https://ice9.ai/dashboard.
4.9 Price Changes. API USERS: We may change pricing with 30 days' advance notice to existing customers. Notice will be sent to your registered email address. If you do not agree to the new pricing, you may terminate your account before the effective date.
5. User Content, Consent, and Licensing
5.1 Consent to Upload. By uploading any image to the Service, you represent and warrant that:
(a) You have the legal right to upload and process the image;
(b) All individuals depicted in the image are at least 18 years of age;
(c) You have obtained all necessary consents, permissions, and releases from any individuals depicted in the image to have their likeness analyzed by the Service;
(d) The image does not violate any third-party rights or any applicable laws; and
(e) The image complies with our Acceptable Use Policy.
5.2 License Grant to Us. You grant us a limited, non-exclusive, royalty-free, worldwide license to:
(a) Process your uploaded images for the purpose of providing the Service to you. This license applies only during the brief period of image processing and terminates immediately when the image is purged from memory.
(b) Use, store, and analyze the analysis results (structured data output) generated from your images for the following purposes: - Providing the Service to you (including retrieval of your results) - Improving the accuracy and performance of our AI models - Training and fine-tuning our models - Developing new features and capabilities - Quality assurance and error analysis - Aggregate analytics and research
You acknowledge that while we do not use uploaded images for training, we may use analysis results (including content flag data) to improve detection accuracy, tune classification thresholds, and reduce false positive/negative rates. This improvement work may include statistical analysis of flag accuracy across aggregate datasets.
(c) Create aggregated, anonymized, or de-identified datasets from analysis results for research, development, and service improvement purposes.
Important clarifications: - We do NOT use your uploaded images for training (images are not stored) - We MAY use the analysis results (structured data) for training and improvement - Aggregated/anonymized data cannot be traced back to your account or specific images - Individual analysis results associated with your account remain private and are not shared with third parties (except as required by law or as described in our Privacy Policy)
5.3 Your License Rights. The Service is licensed for commercial use. You may use the analysis results generated by the Service for any lawful commercial or non-commercial purpose.
5.4 Ownership of Input and Output.
(a) You retain all ownership rights to images you upload to the Service.
(b) The analysis results (structured data output) generated by the Service are provided to you under license for your use as described in Section 5.3.
(c) We claim no ownership rights to your uploaded images.
(d) You acknowledge that similar or identical analysis results may be generated for other users who upload similar images, and that such results are not unique to you.
5.5 Prohibited Content Representations. You represent and warrant that no image you upload to the Service:
(a) Depicts any individual under 18 years of age in any sexual, suggestive, or exploitative context;
(b) Contains child sexual abuse material (CSAM);
(c) Violates any applicable laws or regulations; or
(d) Infringes upon the rights of any third party.
CRITICAL: Uploading images of minors in any inappropriate context is strictly prohibited, may constitute a criminal offense, and will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement authorities.
6. Data Handling and Privacy
6.1 No Image Storage. Uploaded images are NOT stored on our servers. Images are processed entirely in memory during analysis and are immediately discarded upon completion. We have no capability to retrieve, reproduce, or reconstruct images after processing.
6.2 Analysis Data Storage. We store the structured analysis results (metadata, labels, coordinates, confidence scores, etc.) generated from your images. This data is associated with your account and can be retrieved at any time through the API at no additional charge.
6.3 Processing Technology. Image processing is performed using our proprietary multi-model consensus system. While we may use third-party AI models as part of our analysis pipeline, images are processed on our infrastructure and are not transmitted to third-party AI services or APIs for storage.
6.4 Privacy Policy. Our collection, use, and disclosure of your personal information and usage data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
6.5 API Logs. We retain API access logs for security, debugging, and billing purposes. These logs may include timestamps, API endpoints accessed, API keys used (in hashed form), response codes, and error messages, but do not include image data.
API USERS - Log Retention: API logs are retained for 90 days.
6.6 Data Retention Practices. We reserve the right to establish and modify retention periods for analysis results, including the right to delete analysis results from inactive accounts after a period of inactivity. We will provide reasonable notice before implementing material changes to data retention practices.
API USERS - Data Retention Details: - Images: NOT stored (immediately purged after processing) - Analysis results: Retained indefinitely unless you request deletion - API logs: Retained for 90 days - Billing records: Retained for 7 years
7. Acceptable Use Policy
You agree not to use the Service to:
(a) Upload images of individuals without their consent or knowledge;
(b) Upload images of minors (individuals under 18 years of age) in any sexual, suggestive, or exploitative context;
(c) Upload or analyze child sexual abuse material (CSAM) under any circumstances;
(d) Process images for the purpose of surveillance, stalking, harassment, or tracking individuals without their knowledge and consent;
(e) Create, train, or improve facial recognition systems designed for mass surveillance or discriminatory purposes;
(f) Violate any applicable laws or regulations, including privacy laws, data protection laws, and laws governing the use of someone's likeness;
(g) Infringe upon the intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
(h) Attempt to reverse engineer, decompile, or otherwise extract the source code, algorithms, or models of the Service;
(i) Use the Service to generate training data for competing AI models or services without our express written consent;
(j) Circumvent, disable, or interfere with any security features, rate limits, or access controls of the Service;
(k) Use automated means to submit artificially generated, corrupted, or malicious images designed to attack, probe, or degrade the Service;
(l) Resell, sublicense, or redistribute the Service or API access to third parties without our express written consent (note: using the Service as part of your own commercial application is permitted);
(m) Interfere with or disrupt the Service or servers or networks connected to the Service;
(n) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with any person or entity;
(o) Upload images containing graphic violence, illegal content, or content that promotes hatred, discrimination, or violence against individuals or groups;
(p) Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks;
(q) Use content flagging results to make automated decisions affecting individuals without appropriate human review and appeal processes; or
(r) Represent Ice9.ai detection results as legal determinations, expert analysis, or definitive proof of illegal activity without appropriate qualification.
Commercial Use Permitted: Notwithstanding the above, you ARE permitted to use the Service for lawful commercial purposes, including integrating the API into commercial applications, provided such use complies with these Terms.
8. Content Moderation and Technical Safeguards
8.1 Automated Content Detection. We employ NudeNet and other automated content detection technology to attempt to identify nudity or sexually explicit content in uploaded images. When such content is detected, the Service returns coordinate data (bounding boxes) indicating the location of detected content.
8.2 No Image Censoring or Filtering. The Service does NOT censor, filter, obscure, or modify images in any way. The Service returns only coordinate data. You are responsible for determining how to use this data, including whether and how to apply visual censoring in your own application.
8.3 Technology Limitations. You acknowledge and agree that:
(a) No automated content detection system is perfect or 100% accurate;
(b) The Service may produce false positives (flagging appropriate content) or false negatives (failing to detect inappropriate content);
(c) Content moderation features are provided as a tool to assist you but do not guarantee detection of all inappropriate content;
(d) You remain solely responsible for ensuring your use of the Service complies with all applicable laws and these Terms.
8.4 Age Verification Limitations. We do not have reliable technical means to verify the age of individuals depicted in uploaded images. The burden is entirely on you to ensure compliance with Section 1.1, Section 5.1(b), and Section 7(b) regarding the age of individuals in uploaded images.
8.5 Enforcement and Termination. We reserve the right to review API usage patterns, account activity, and service usage at our discretion. Any violation of Section 7, particularly Section 7(b) or 7(c), will result in immediate account termination without refund. Violations involving minors or illegal content will be reported to NCMEC and appropriate law enforcement authorities as required by law.
8.6 User Reporting. If you become aware of any usage of the Service that violates these Terms, you agree to report it to us immediately at abuse@ice9.ai. We will investigate all reports and take appropriate action.
8.7 No Liability for User Misuse. While we provide content moderation tools and enforce our Acceptable Use Policy, we are not liable for how users choose to use the Service or for content that users upload in violation of these Terms. You acknowledge that our technical safeguards are provided as an additional layer of protection but do not diminish your obligations under these Terms.
8.8 No Liability for Detection Results. WE ARE NOT LIABLE FOR:
(a) Actions taken based on content flagging results, including but not limited to account suspensions, content removals, law enforcement referrals, or legal proceedings;
(b) False positives that result in incorrect enforcement actions;
(c) False negatives that result in failure to detect restricted or illegal content;
(d) Misinterpretation or misuse of detection results by users;
(e) Downstream consequences of any decisions made using analysis results or content flags;
(f) Any claim that content flagging results constitute evidence, expert opinion, or legal determination.
Content flagging is a probabilistic detection tool. You are solely responsible for implementing appropriate human review, verification processes, and quality control before taking action based on detection results.
9. Intellectual Property
9.1 Our Rights. The Service, including all software, algorithms, AI models, designs, graphics, text, APIs, and other content (excluding User Content and analysis results), is owned by us or our licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
9.2 Limited License to Use Service. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. This license does not include any right to:
(a) Copy, modify, or create derivative works of the Service;
(b) Reverse engineer or attempt to extract the source code, algorithms, or AI models;
(c) Sell, rent, lease, sublicense, or otherwise transfer the Service to third parties (except as permitted for commercial integration); or
(d) Remove or alter any proprietary notices or labels.
9.3 Trademarks. "Ice9.ai," "Ice 9 Designs," and all related logos and designs are trademarks of Ice 9 Designs. You may not use these trademarks without our prior written consent.
9.4 Feedback. If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation to you.
10. User Responsibilities
10.1 Compliance with Law. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including but not limited to:
(a) Privacy laws and data protection regulations (GDPR, CCPA, etc.);
(b) Laws governing biometric data and facial recognition;
(c) Laws protecting publicity rights, likeness rights, and personality rights;
(d) Export control and sanctions laws;
(e) Laws prohibiting child exploitation and abuse material; and
(f) Any industry-specific regulations applicable to your use case.
10.2 Third-Party Rights. You are responsible for obtaining all necessary permissions, consents, and releases from individuals depicted in images you process through the Service.
10.3 Use of Analysis Results. Once you receive analysis results from the Service, you are solely responsible for how you use, store, or distribute those results. We are not responsible for any consequences arising from your use of the Service or analysis results.
10.4 Security. You are responsible for implementing appropriate security measures in your applications that use the Service, including:
(a) Protecting API keys from unauthorized access;
(b) Securely transmitting images to the Service (using HTTPS);
(c) Implementing access controls in your applications;
(d) Complying with applicable security standards for any personal data processed.
10.5 Indemnification. You agree to indemnify, defend, and hold harmless Ice 9 Designs, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
(a) Your use of the Service;
(b) Your violation of these Terms;
(c) Your violation of any rights of another party, including any individuals depicted in images;
(d) Your violation of any applicable laws or regulations;
(e) Content you upload to the Service; or
(f) Your use of analysis results generated by the Service.
10.6 Law Enforcement and Government Use. If you are using the Service for law enforcement, regulatory enforcement, or government purposes, you acknowledge and agree that:
(a) Detection results are not definitive determinations of illegal activity;
(b) You must implement appropriate verification and review processes before taking enforcement action;
(c) You are responsible for compliance with all applicable laws governing evidence collection, chain of custody, and civil rights;
(d) The Service does not provide forensic-grade analysis or chain of custody guarantees;
(e) You will not represent Ice9.ai analysis results as expert testimony or definitive proof without appropriate qualification;
(f) You assume all liability for enforcement actions taken based on Service results.
PART 2: API-SPECIFIC TERMS
(Additional terms for API users)
1. API Access and Authentication
1.1 API Keys. Upon registration for API access, you will be issued one or more API keys. API keys are confidential credentials that authenticate your access to the API. You must:
(a) Keep API keys confidential and secure;
(b) Not share API keys with unauthorized parties;
(c) Not embed API keys in client-side code or publicly accessible repositories;
(d) Rotate API keys immediately if you suspect compromise;
(e) Notify us immediately at security@ice9.ai if API keys are compromised.
1.2 API Key Security Requirements. You must:
- Store API keys securely using industry-standard secret management practices
- Never expose API keys in client-side code, public repositories, or version control systems
- Use environment variables or secure credential storage systems
- Rotate API keys at least every 90 days for production use
- Implement IP allowlisting where possible
- Use separate API keys for development, staging, and production environments
1.3 API Key Compromise. If you suspect your API key has been compromised:
- Revoke the compromised key immediately through your account dashboard
- Generate a new API key
- Notify us at security@ice9.ai within 24 hours
- Review API access logs for unauthorized usage
1.4 Unauthorized Use. You are responsible for all API calls made using your API keys, including unauthorized use. We reserve the right to charge you for all API usage associated with your API keys, even if such usage was unauthorized.
2. API Usage and Rate Limits
2.1 Rate Limits. The API is subject to rate limits to ensure fair usage and system stability. Current rate limits are documented at https://ice9.ai/docs/rate-limits.
Free Demo: - 10 requests per hour - 100 requests per day - 1 concurrent request
Paid Tiers: Rate limits vary by plan. Typical paid tier limits: - Starter: 100 requests per minute, 10,000 requests per day - Professional: 500 requests per minute, 100,000 requests per day - Enterprise: Custom limits negotiated
Exceeding rate limits may result in temporary throttling or request rejection.
2.2 Rate Limit Headers. The API returns rate limit information in response headers:
X-RateLimit-Limit: 100

2.3 Rate Limit Exceeded. When you exceed rate limits, the API will return:
- HTTP Status Code: 429 Too Many Requests
- Retry-After header indicating when to retry
- Error message in JSON format
You must implement exponential backoff and respect Retry-After headers. Persistent abuse of rate limits may result in temporary or permanent API suspension.
2.4 Burst Allowance. Paid tiers include a burst allowance that permits brief spikes above the standard rate limit. Sustained high usage beyond your plan's limits may result in throttling.
2.5 Fair Use. While there is no hard cap on total monthly requests for paid plans, we reserve the right to investigate and potentially restrict usage that we determine to be abusive or inconsistent with normal use patterns. While the Service is licensed for commercial use, you agree to use the API in a manner consistent with its intended purpose and not to abuse or overload our systems.
3. API Request Format and Requirements
3.1 Request Format. All API requests must:
- Use HTTPS (HTTP is not supported)
- Include a valid

3.2 Image Requirements. Images submitted to the API must meet the following requirements:
- File formats: JPEG, PNG, WebP, GIF (first frame only), BMP, TIFF
- Maximum file size: 20 MB per image
- Maximum dimensions: 8192 x 8192 pixels
- Minimum dimensions: 32 x 32 pixels
- Color space: RGB or grayscale
- Encoding: Valid image encoding (corrupted images will be rejected)
3.3 Request Timeout. API requests will timeout after 60 seconds. Ensure your client has appropriate timeout settings.
3.4 Retry Logic. Implement exponential backoff for retry logic:
Initial retry: 1 second
Second retry: 2 seconds
Third retry: 4 seconds
Max retries: 3
Only retry on: - HTTP 5xx errors (server errors) - HTTP 429 (rate limit exceeded, respecting Retry-After header) - Network timeouts or connection errors
Do NOT retry on: - HTTP 4xx errors (client errors, except 429) - HTTP 401 (unauthorized - check your API key) - HTTP 400 (bad request - fix your request)
3.5 Error Handling. The API returns structured error responses:

Include the request_id when contacting support about errors.
3.6 Idempotency. Image analysis requests are NOT idempotent. Submitting the same image multiple times will result in multiple analysis operations and charges. Implement client-side caching or deduplication if needed.
3.7 Async Processing. For large batches, we may introduce asynchronous processing. Check the API documentation for updates.
4. API Versioning and Changes
4.1 API Versioning. The API uses semantic versioning. Current version: v1
API endpoints include the version: https://api.ice9.ai/v1/analyze
4.2 Breaking Changes. We will not introduce breaking changes to the current API version. Breaking changes will be introduced in new API versions (v2, v3, etc.). We reserve the right to modify the API, including endpoints, request/response formats, and functionality. We will provide reasonable advance notice of breaking changes and maintain backward compatibility where feasible.
4.3 Deprecation Policy. When deprecating an API version:
- Minimum 12 months' notice before deprecation
- Email notification to all active API users
- Documentation updates
- Migration guide provided
4.4 Non-Breaking Changes. We may make non-breaking changes without notice, including:
- Adding new API endpoints
- Adding new optional request parameters
- Adding new fields to API responses
- Improving performance or accuracy
- Bug fixes
4.5 Changelog. API changes are documented at https://ice9.ai/changelog. We recommend subscribing to changelog notifications.
5. Support and Service Levels
5.1 Uptime Target. We target 99.9% uptime for the API (excluding scheduled maintenance). This is a target, not a guarantee, for standard paid plans. We strive to maintain high availability but do not guarantee any specific uptime percentage for the Free Demo. Paid API customers may be eligible for service level agreements (SLAs) under separate enterprise agreements.
5.2 Scheduled Maintenance. Scheduled maintenance will be announced at least 48 hours in advance via:
- Email notification
- Status page (status.ice9.ai)
- API response headers (when maintenance is imminent)
5.3 Incident Response. In the event of an outage:
- Status updates posted to status.ice9.ai
- Incident resolution updates every 2 hours during business hours
- Postmortem published within 5 business days
5.4 Support Tiers.

5.5 Support Scope. Support covers:
- API integration questions
- Error troubleshooting
- Billing inquiries

Support does NOT cover: - Custom application development - Writing code for your integration - General AI/ML consulting
6. Commercial Use and Restrictions
6.1 Commercial Use Permitted. The API is licensed for commercial use. You may:
- Integrate the API into commercial applications
- Use analysis results in products you sell
- Provide services to your customers using the API
- Use the API for internal business purposes
6.2 Restrictions on Commercial Use. You may NOT:
- Resell raw API access to third parties (white-labeling)
- Reverse engineer the Service to create competing services
- Use the API to train competing AI models
- Sublicense the API to third parties
Exception: You may integrate the API into your own applications and services that you provide to your customers, provided those services add substantial value beyond raw API access.
6.3 Attribution. While not required, we appreciate attribution when you use the API in public-facing applications. Suggested attribution: "Powered by Ice9.ai" with a link to https://ice9.ai.
7. Enterprise Agreements
7.1 Enterprise Terms. Enterprise customers may negotiate custom terms including:
- Custom rate limits and burst capacity
- Service Level Agreements (SLAs) with uptime guarantees
- Volume discounts
- Dedicated infrastructure
- Custom deployment options
- Priority support
- Custom contract terms

7.2 SLA Credits. Enterprise customers with SLA agreements may be eligible for service credits if uptime SLAs are not met, as specified in their contract.
8. API-Specific Data Handling
8.1 Data Processing Agreement (DPA). Enterprise customers may request a Data Processing Agreement (DPA) for GDPR compliance. Contact legal@ice9.ai.
8.2 Data Residency. Standard API processing occurs in US-based data centers. Enterprise customers may request data residency in specific regions (subject to availability and additional fees).
8.3 Data Deletion Requests. You may request deletion of analysis results via:

9. API Compliance Requirements

9.2 Compliance Audits. Enterprise customers may request compliance documentation including:

9.3 Your Compliance Obligations. You are responsible for ensuring your use of the API complies with:
- GDPR (if processing EU personal data)
- CCPA (if processing California resident data)
- BIPA (Illinois biometric privacy law, if applicable)
- HIPAA (the API is NOT HIPAA-compliant and should not be used with PHI)
- Industry-specific regulations applicable to your business
10. Additional Prohibited Uses for API
In addition to the General Acceptable Use Policy, API-specific prohibited uses include:
10.1 Technical Abuse - Deliberately sending malformed or malicious requests - Attempting to bypass rate limits or access controls - Probing for vulnerabilities or security flaws - Denial-of-service attacks or excessive load testing without permission
10.2 Data Mining - Using the API to reverse engineer our AI models - Extracting training data from the Service - Building competing datasets or models - Systematic scraping of our documentation or examples
10.3 Surveillance and Privacy Violations - Building facial recognition or identification systems without explicit consent - Tracking individuals without their knowledge and consent - Processing biometric data in violation of applicable laws - Creating databases of individuals' physical characteristics without consent
10.4 Discriminatory Use - Using the API to make decisions about credit, employment, housing, or other legally protected areas without proper safeguards - Creating systems that discriminate based on protected characteristics - Biometric profiling for discriminatory purposes

11. Disclaimers
11.1 No Warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
11.2 AI Technology Limitations. The Service uses artificial intelligence and computer vision technology that may produce unpredictable, imperfect, or inaccurate results. We make no representations or warranties regarding the accuracy, completeness, reliability, or quality of any analysis results. You acknowledge that:
(a) AI models may produce errors, hallucinations, or incorrect identifications;
(b) Confidence scores are estimates and do not guarantee accuracy;
(c) Analysis results should not be relied upon as the sole basis for critical decisions;
(d) The multi-model consensus system improves accuracy but does not eliminate errors;
(e) You are responsible for validating and verifying analysis results for your use case;
(f) Content flagging detects patterns and objects but cannot determine intent, context, legality, or policy compliance;
(g) Detection of an object or pattern does not mean the content violates any law or policy; and
(h) Absence of detection does not mean content is compliant or safe.
11.3 Content Moderation Limitations. We make no warranty that content moderation features will detect all inappropriate content or that all flagged content is actually inappropriate. Content moderation is provided as a tool to assist you but does not replace your own review and judgment.
Content moderation (NudeNet) has known limitations: - False positives: May flag art, medical images, or swimwear - False negatives: May miss certain types of inappropriate content - Not 100% reliable for safety-critical applications - Designed as a tool to assist human review, not replace it
11.4 Third-Party Services. The Service may integrate with or rely on third-party services (such as payment processors, authentication providers, or cloud infrastructure). We are not responsible for the availability, functionality, security, or terms of these third-party services.
11.5 No Legal or Compliance Advice. Nothing in the Service constitutes legal, compliance, or professional advice. You are solely responsible for determining whether your use of the Service complies with applicable laws and regulations.
11.6 API Availability. API USERS: We do not warrant that the API will be available 100% of the time or that it will be error-free. The API is provided "as is" and "as available."
11.7 Result Accuracy. API USERS: We do not warrant that analysis results will be accurate, complete, or suitable for your particular purpose. You must validate results for your use case.
11.8 Third-Party Models. API USERS: While we use multiple AI models to improve accuracy, we do not guarantee the behavior or accuracy of any specific model or version.
11.9 API Changes. API USERS: We do not warrant that the API will remain unchanged or that features will always be available.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ICE 9 DESIGNS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR USE OR INABILITY TO USE THE SERVICE;
(B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
(C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
(D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;
(E) ANY ERRORS, INACCURACIES, OR OMISSIONS IN ANY ANALYSIS RESULTS OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF OR RELIANCE ON ANY ANALYSIS RESULTS;
(F) ANY FAILURE OF CONTENT MODERATION FEATURES TO DETECT INAPPROPRIATE CONTENT OR ANY FALSE POSITIVES GENERATED BY SUCH FEATURES;
(G) THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY;
(H) ANY CLAIMS RELATED TO YOUR USE OF ANALYSIS RESULTS OR IMAGES PROCESSED THROUGH THE SERVICE;
(I) ANY CLAIMS ARISING FROM ENFORCEMENT ACTIONS, INVESTIGATIONS, LEGAL PROCEEDINGS, OR OTHER DECISIONS MADE BASED ON ANALYSIS RESULTS OR CONTENT FLAGS;
(J) ANY CLAIMS BY THIRD PARTIES SUBJECT TO ENFORCEMENT ACTIONS BASED ON SERVICE RESULTS;
(K) ANY WRONGFUL ARREST, PROSECUTION, CONTENT REMOVAL, ACCOUNT SUSPENSION, OR OTHER ACTION TAKEN BASED ON FALSE POSITIVE DETECTION RESULTS;
(L) API USERS: API DOWNTIME, ERRORS, OR REDUCED PERFORMANCE (EXCEPT AS SPECIFIED IN ENTERPRISE SLA AGREEMENTS);
(M) API USERS: DECISIONS MADE BASED ON API ANALYSIS RESULTS OR FOR LOSSES RESULTING FROM INACCURATE OR INCOMPLETE RESULTS;
(N) API USERS: THIRD-PARTY CLAIMS ARISING FROM YOUR USE OF THE API, INCLUDING CLAIMS RELATED TO PRIVACY, INTELLECTUAL PROPERTY, OR DISCRIMINATION; OR
(O) API USERS: ISSUES ARISING FROM YOUR INTEGRATION OF THE API INTO YOUR APPLICATIONS OR SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. California-Specific Provisions
13.1 California Residents. Under California Civil Code Section 1789.3, California users are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
13.2 CCPA Rights. If you are a California resident, you have certain rights under the California Consumer Privacy Act ("CCPA") regarding your personal information. Please refer to our Privacy Policy for information about your CCPA rights and how to exercise them.
14. Dispute Resolution
14.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
14.2 Arbitration. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in California, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.
14.3 Class Action Waiver. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you and we each waive any right to a jury trial.
14.4 Exceptions. Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Service or intellectual property infringement without first engaging in arbitration.
14.5 Informal Resolution. Before initiating arbitration, you agree to first contact us at legal@ice9.ai to attempt to resolve the dispute informally.
15. General Provisions
15.1 Changes to Terms. We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
15.2 Entire Agreement. These Terms, together with our Privacy Policy and any other incorporated policies, constitute the entire agreement between you and us regarding the use of the Service and supersede all prior agreements and understandings.
15.3 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15.4 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.5 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
15.6 Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
15.7 Survival. Sections 5.3 (Your License Rights), 5.4 (Ownership of Input and Output), 9 (Intellectual Property), 10.5 (Indemnification), 11 (Disclaimers), 12 (Limitation of Liability), 14 (Dispute Resolution), and 15 (General Provisions) shall survive any termination or expiration of these Terms.
15.8 Export Control. The Service may be subject to U.S. export control laws and regulations. You agree not to export, re-export, or transfer the Service or any analysis results in violation of such laws.
15.9 Government Use. If you are a U.S. government entity, the Service is provided as "Commercial Computer Software" as defined in FAR 2.101 and is subject to restricted rights as described in these Terms.
15.10 Language. These Terms are prepared in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
15.11 API Termination and Suspension. API USERS:
Suspension: We may suspend your API access immediately without notice if: - Payment is more than 15 days overdue - We detect violations of these Terms - We detect unusual activity suggesting account compromise - Required to comply with legal obligations
Termination by Us: We may terminate your API access with 30 days' notice, or immediately for: - Material breach of these Terms - Fraudulent activity - Violation of laws - Abuse or misuse of the Service
Termination by You: You may terminate your API access at any time by: - Canceling your subscription through the dashboard - Contacting support@ice9.ai - Deleting your account
Effect of Termination: Upon termination: - Your API keys will be revoked immediately - You will be billed for usage through the termination date - You will retain access to your analysis results for 30 days for download - Analysis results will be deleted after 30 days unless you request earlier deletion or extended retention
